Terms and Conditions

1. Acceptance of Terms

1.1 By enrolling in any service provided by Side By Side Dog Training (“we”, “us”, “our”), you (“client”, “you”, “your”) agree to be bound by these Terms and Conditions.
1.2 Our services are non-transferable without written permission.
1.3 By using our services, you also agree to follow any guidelines, policies, or updates provided via our website, email, or in person.
1.4 You confirm you are over 18 years of age and legally capable of entering into this agreement.

2. Description of Services

2.1 We offer the following services (“Services”):
• Group Dog Training Classes
• Private Dog Training Sessions
• Behaviour Consultations
2.2 All training is based on positive reinforcement principles. We do not use or permit aversive tools such as prong collars, shock/e-collars, or check chains.

3. Registration and Safety Requirements

3.1 All information provided during registration must be accurate and up to date. Notify us promptly of any changes.
3.2 You must disclose any behavioural concerns, including aggression or reactivity, before attending class.
3.3 Handlers must follow all trainer instructions to ensure the safety of participants, animals, and staff.
3.4 Dogs must be handled by someone physically capable of managing them safely.
3.5 Covered, enclosed footwear is required at all sessions. Handlers without appropriate footwear may be excluded for safety.
3.6 Children under 14 may attend as observers but must not handle dogs during sessions. Children must be supervised and must not approach other dogs without permission.
3.7 We recommend sun-safe clothing and water for outdoor sessions.

4. Payments, Cancellations & Refund Policy

4.1 Full payment is required in advance to secure your booking.
4.2 Cancellations made within 72 hours’ written notice are eligible for a full refund or credit.
4.3 No refunds are provided for cancellations made within 72 hours of a session.
4.4 Missed sessions without notice are non-refundable and may be forfeited.
4.5 We may, at our discretion, offer to reschedule a session or provide credit in extenuating circumstances (fees may apply).
4.6 Refunds are not issued due to change of mind once training has commenced.

5. Group Class Requirements

6.1 Dogs must remain on lead at all times unless directed otherwise by the trainer.
6.2 Required items:
• Flat collar or harness
• Non-retractable lead
• High-value treats
• Vaccination certificate
6.3 All dogs must be fully vaccinated (C5 or equivalent).

7. Suitability for Group Classes

7.1 Not all dogs are suited for group environments. If your dog exhibits fear, reactivity, or aggression, we may recommend private training.
7.2 We reserve the right to pause or terminate participation if behaviour poses a risk to others.

8. Sick or Injured Dogs

8.1 Please notify us if your dog is unwell or recovering from surgery. Dogs must not attend class if they are unwell or injured.
8.2 Rescheduling due to illness is possible with notice and at our discretion.

9. Assumption of Risk

9.1 You acknowledge that dog training involves inherent risks.
9.2 You agree to assume all risks and release Side By Side Dog Training from liability for any injury, loss, or damage incurred during sessions.
9.3 You are responsible for your dog’s behaviour at all times.

10. Weather Policy

10.1 Outdoor classes may be postponed due to storms, extreme heat, or unsafe conditions.
10.2 We will notify you as early as possible and reschedule the session.
10.3 You are responsible for assessing your dog’s comfort and safety in different weather conditions.

11. Service Modifications

11.1 We reserve the right to change class dates, venues, times, or content if necessary.
11.2 We will notify you of changes as early as possible and make reasonable efforts to minimise disruption.

12. Media Consent

12.1 Photos and videos may be taken during sessions and used for marketing or educational purposes.
12.2 By participating, you consent to this use unless you notify us in writing beforehand.
12.3 Personal details will not be shared without your explicit permission.

13. Code of Conduct

13.1 Clients must behave respectfully toward others at all times.
13.2 Aggressive, abusive, or disruptive behaviour will result in removal from class.
13.3 Dogs must not be allowed to interact with others unless invited by the trainer.

14. Indemnity

14.1 You agree to indemnify and hold harmless Side By Side Dog Training, its employees, and agents from any claims arising from your or your dog’s participation in our services.

15. Termination of Services

15.1 We reserve the right to terminate enrolment at any time for breach of these Terms, inappropriate conduct, or if your dog is not suited to the class environment. No refunds will be issued in such cases.

16. Entire Agreement

16.1 These Terms constitute the entire agreement between you and Side By Side Dog Training. Any additional terms must be agreed to in writing.

17. Governing Law

17.1 These Terms and Conditions are governed by the laws of Western Australia. Any disputes will be resolved under WA jurisdiction.
